Terms & Conditions

1. OBJECT :

These conditions of sale are concluded firstly by TM Planning whose registered office is located in Shiga Prefecture, Japan and secondly by individual or corporate customers seeking to make a purchase via the official website of Izumi Takada, (hereinafter “the Buyer”).

These conditions of sale are intended to establish the contractual relationship between TM Planning and the Buyer and the conditions applicable to any purchase made through the online shop of Izumi Takada Official Website.

TM Planning will be responsible for taking and delivering orders. Similarly, payments will be made to TM Planning.

Any order taken in respect of a product appearing on the online shop on the website www.izumitakada.com implies that these conditions of sale have been read, understood and accepted.

TM Planning reserves the right to modify these general conditions of sale from time to time, in accordance with changes in the law. Any modifications made shall become applicable when they are posted online.

2. SUBMISSION OF THE ORDER :

Contractual information will be confirmed by e-mail to the address indicated by the Buyer on the purchase order. The products for sale are those which appear in the STORE published on the official website of Izumi Takada and are subject to quality control. The products are offered for sale while stocks last. As stocks are limited in quantity, a notice will be placed on items that are out of stock. However, in the event of error concerning the availability of an article, TM Planning will refund the Buyer.

On no account may an order be placed by professional salespersons either jointly or separately, for the purposes of their commercial activities, regardless of what means they use to market their products. The Buyer recognizes and accepts that TM Planning reserves the right to refuse an order manifestly placed by a professional salesperson, in light of the number of products ordered in a single order and of the number of independent orders placed for the same product, compared to the usual quantities ordered by the average consumer.

3. PRICE :

The prices displayed in the STORE are in Japanese Yen excluding tax. The prices displayed do not include shipping costs. Customs duties shall be borne by the Buyer.

TM Planning reserves the right to change the prices of items at any time. Items will be invoiced based on the applicable prices at the time an order is confirmed. The price charged for items on sale is therefore the price indicated during the placing of the order.

In this regard, the order must be paid for in full when it is placed.

4. CONFIRMATION OF THE ORDER :

The Buyer who wishes to purchase a product online must:

1 - confirm the basket containing his or her order after having verified the contents thereof;
2 - provide or confirm the billing and delivery address;
3 - confirm his or her order and the payment for such order; and
4 - confirm the payment.

The confirmation of the order entails the full and complete acceptance of these general conditions of sale and the acknowledgement that they have been read and understood in their entirety.

All the data provided and the recorded confirmation shall serve as proof of the transaction. The confirmation shall be equivalent to the signature and acceptance of the transactions made.

TM Planning shall communicate the following information in a first e-mail: the registration and confirmation of the order, the invoice and the delivery time for the order.

TM Planning shall communicate the following information in a second e-mail: the delivery number transmitted to the dispatcher, which allows the Buyer to track the delivery as far as possible.

5. PAYMENT & SECURITY :

Payments shall be made through a PayPal account.

PayPal is certified PCI DSS (Payment Card Industry Data Security Standard) by Visa and MasterCard.

The Buyer’s account shall only be debited during the confirmation of payment for the order and during the validation of the amount pertaining to the product and the delivery charges.

6. DELIVERIES

Delivery shall be made under the following conditions. 

For deliveries to any country, orders will be dispatched by the international e-packet service by JAPAN POST.

A Delivery charge including shipping preparation is calculated automatically refer to the table below and added to the displayed CD price. The maximum number of CDs that can be purchased at once is 12.

Standard deliveries are made around 10 working days as from the date on which TM Planning hands over the parcel to the dispatcher. Delivery is subject to the signature of the recipient. Therefore, TM Planning will receive all delivery records.

Any customs duties and levies shall be borne by the Buyer.

The products offered for sale using this system are intended for Buyers residing in the following countries, Thailand, Malaysia, Indonesia, Vietnam, Philippines and Mexico.

The Buyer listed in the table above may track the delivery at any time on the websites of JAPAN POST using the tracking number previously provided in the e-mail notifying dispatch of the parcel.

Once the order is confirmed, the address provided by the Buyer for receipt of the order can no longer be changed.

Neither the dispatcher nor TM Planning may be held liable if the order cannot be delivered on account of a mistake in the delivery address (post box addresses are not an accepted mode of delivery).

7. RETURNS :

The Buyer cannot return the provided products unless the CD has been damaged. In the case of a damaged CD, if the Buyer requires a replacement, the Buyer can return it within 15 working days of the date of the order.

For any returns, the Buyer must send the product to the indicated address of TM Planning in Shiga Prefecture, Japan

If the product returned is not damaged, TM Planning will return it to the Buyer, who must bear the delivery costs.

Upon receipt of the returned merchandise, the Buyer will be informed by e-mail of the processing of his or her replacement request. TM Planning reserves the right to refuse returned items if returns outside the specified time frame, where the right of withdrawal has not been exercised within the time limit of 15 working days.

TM Planning undertakes the replacement of returned products within 15 days as from the date on which TM Planning was informed of the Buyer’s replacement decision. The Buyer will receive a confirmation e-mail, and will also be reimbursed for the delivery charges.

8. GUARANTEE :

The CD is guaranteed against accidental damage occurring during shipment. However, we are not liable for damage to the jewel case alone, in the event that there is no damage to the CD.

The Customer acknowledges and accepts that he or she cannot make a claim for a refund, either in whole or in part, for items purchased on the website except in case of the lost delivery.

In the case that JAPAN POST acknowledges the lost delivery by the tracking system, the Buyer can require a refund for it.
When the Buyer requires a replacement, the Buyer shall so inform TM Planning by e-mail. The Buyer must return the defective product within 15 days as from the date of delivery of the order. TM Planning will bear the costs relating to the return.;

9. LIABILITY :

In offering goods for sale online, TM Planning shall be bound only by an obligation of means: it may not be held liable for any damages arising from the use of the Internet, such as loss of data, hacking, virus, interruption or other unexpected problems.

As to the failure to perform or the inadequate performance of the contract, TM Planning may divest itself of its responsibility be proving that it is ascribable either to the consumer or to the unforeseeable and irremediable act of a third party to the contract, or to a case of force majeure. Force majeure encompasses unavoidable circumstances not connected to the parties, despite all reasonable efforts to prevent them. Force majeure also encompasses the immobilization of means of transport, earthquakes, fire, storms, floods, lightning strikes, the interruption of telecommunications network services, or difficulties inherent in telecommunications networks not linked to the parties.

The party affected by force majeure shall inform the other party within five working days following the date on which it became aware of the force majeure. Both parties shall then agree on the conditions for continuing the performance of the contract.

10. INTELLECTUAL PROPERTY :

No person may reproduce, exploit, disseminate or use for any purpose, even in part, the contents of the website, be they visual or audio. All simple or hypertext links are strictly prohibited except with the prior written agreement of TM Planning.

Accordingly, any copying and use of the Izumi Takada Official Website brand or any parasitism arising from the exploitation of the website shall be automatically prosecuted and sanctioned.

11. PROTECTION OF
PERSONAL DATA :

Within TM Planning, access to such information may be granted to persons responsible for marketing, the sales service, customer relations and prospecting services, administrative services, logistics and information technology services and their superiors.

TM Planning reserves the right to collect information on Buyers.

The data collected may not be used for commercial ends other than those provided for in regard to the website and any other ends that may be subsequently sought by TM Planning. Data used for commercial prospection may be stored for three months with effect from the end of the commercial relationship.
